Analytical result
Where the strategy’s value depends upon process-created cost, delay, ambiguity, exposure, or asymmetry that an immediate merits decision would remove, the operative leverage is conditionally classified as process-dependent rather than merits-dependent.
Possible falsifier
A merits theory sufficient to justify the demanded result without relying on process-created cost or delay.
Material limitations
This does not by itself establish unlawful motive, bad faith, abuse of process, sanctionable conduct, or an available remedy. Those conclusions require their own governing standards, evidence, authority, and causal proof.
Correction path
Every material claim must remain open to inspection and correction.
